oa Comparative and International Law Journal of Southern Africa - Religion in custody disputes - a comparison of American and Australian judicial attitudes

 

Abstract

In both Australial and the United States of America the paramount consideration in the resolution of custody disputes will be the welfare of the child in question. At the same time, it is clear that there are a considerable number of specific considerations which it will be necessary for the court to take into account when deciding such matters. One of such matters is the question of the religious views of the parties involved and it is the purpose of this article to examine comparatively the attitudes towards them expressed by the judiciary in Australia and the United States.
