This is the fourth edition and it again covers relevant principles of commercial law. Once more a new edition of Neethling, Potgieter and Scott's Case book on the law of delict is to be welcomed. This third edition is a much more expanded volume than its predecessor although, taking into account the pace and volume of development in this area of the law, the authors are to be commended for keeping the size of the book within manageable proportions.

Dean of the Faculty of Law Prof David Ailola, formerly from the Department of Mercantile Law, was appointed Dean of the Faculty of Law with effect from 1 January 2002. Sadly, he died on 21 January 2002 after a short illness. A memorial service for Prof Ailola was held at Unisa on 24 January 2002. Professor Ailola was appointed Professor in the Department of Mercantile Law in 1998, specialising in cross-border insolvency law.

The plaintiff was a customer of the defendant bank. S, an employee employed by the plaintiff, obtained cheques belonging to the plaintiff, deposited them into an account under the name of Bond Equipment (Pretoria), whereas the plaintiff's name was Bond Equipment (Pretoria) (Pty) (Ltd). The defendant bank collected payment for the cheques for Bond Equipment (Pretoria) instead of the plaintiff, notwithstanding the absence of any endorsement by the plaintiff.
