Vicarious liability of a plaintiff employer - ABSA Bank Ltd v Bond Equipment (Pretoria) (Pty)(Ltd) 2001 (1) SA 372 (SCA)
The plaintiff was a customer of the defendant bank. S, an employee employed by the plaintiff, obtained cheques belonging to the plaintiff, deposited them into an account under the name of Bond Equipment (Pretoria), whereas the plaintiff's name was Bond Equipment (Pretoria) (Pty) (Ltd). The defendant bank collected payment for the cheques for Bond Equipment (Pretoria) instead of the plaintiff, notwithstanding the absence of any endorsement by the plaintiff.
