Abstract

In South Africa, if a juvenile delinquent is sentenced to imprisonment, rehabilitation will not be accomplished. The regulations of the Correctional Servies Act are not strictly applied in practice. The author makes it clear that it is problematic to detain a juvenile delinquent with an adult prisoner. It is in the interest of the society to rehabilitate a juvenile delinquent, for the reason that a rehabilitated juvenile delinquent plays a vital role in social and economical spheres. It is a matter of importance to create alternative sentencing methods that will promote the rehabilitation of juvenile delinquents. Diversion must be kept in mind. The Child Justice Bill unlocks important alternative sentencing options and for this reason must also be kept in mind.

Gevangenisstraf soos tans toegepas in Suid Afrika bewerkstellig nie rehabilitasie by jeugoortreders nie. Die bepalings van die Wet op Korrektiewe Dienste 111 van 1998 word nie streng in die praktyk toegepas nie. Die outeur wys daarop dat dit problematies is om jeugoortreders saam met volwasse gevangenes in gevangenisse te plaas. Dit is egter van groot belang vir die samelewing om jeugoortreders te rehabiliteer, sodat hulle weer 'n bydrae kan lewer op sosiale en ekonomiese vlak. Alternatiewe hanteringsvorme wat rehabilitasie sal bevorder, moet dringend vir jeugoortreders geskep en aan hulle opgelê word. Daar kan ook van herkanalisering gebruik gemaak word. moet voor oë gehou word aangesien dit belangrike hanteringsmoontlikhede ontsluit.
