Abstract

Izimpawu ezithile zehlukanisa umthetho nosiko lwamaSwazi kunoma yiliphi elinye iqoqo lezinkambiso. Umehluko phakathi ko 'mthetho' ne'siko' ukhombisa indlela yokubheka izinto, engahle ithathwe njengenkinga yokuthi yikuphi okufanele kanye nokungafanele kuthathwe njengomthetho wamaSwazi. Umbhali ubhekisa ekwenziweni kosiko (umhambo), eqhazeni elibanjwa yindlela okuthathwa ngayo isiko eliphathelene nezomlingo nezenkolo kanye nasesikhundleni nasekusebenzeni kwezinkantolo zendabuko zamaSwazi, phakathi kokunye. Ugcizelela ukuthi ukuntuleka kwamakhodi abhaliwe kanye namarekhodi amacala kwenza kungakwazeki ukwehlukanisa imithetho esemthethweni kweminye imithetho yokuziphatha.

Specific features distinguish Swazi law and custom from any other unsystematic set of norms. The distinction between 'law' and 'custom' suggests a possible line of approach to the problem of what must, and what must not, be regarded as Swazi law. The author refers to, among other things, the enforcement of custom (umhambo), the role of a magical-religious conception of custom, and the position and functioning of indigenous Swazi courts. He emphasises that the lack of written codes and records of cases makes it impossible to isolate legal rules absolutely from other rules of conduct.
