oa Codicillus - The legal protection of geographical indications

 

Abstract

The issue of geographical indications has been controversial for many years. When names that are protected in one region are commonly used in another, the notion becomes contested. The author proposes that member states of the World Trade Organisation should develop the protection of geographical indications within the wording and spirit of the Agreement on the Trade-related Aspects of Intellectual Property (TRIPS), which prescribes minimum standards concerning the availability, scope and use of intellectual property rights. It is important that new ways of enhancing the international protection of geographical indications be found, in order to give countries like South Africa a competitive advantage.
