What Courts determine and enforce custody? Matters of custody are determined solely by the civil courts. On dissolution of the marriage by divorce the question of custody will be determined by the Supreme Court. Under the Children's Act a Children's Court may make an order in respect of a child adjudged to be in need of care, whereby such child is placed in the custody of one or other of the parents or of some other suitable person or institution.
