In terms of Section 28 of the Copyright Act No. 63 of 1965 the Copyright Tribunal may grant a ""licence"" to an applicant to whom a licence to e.g. perform a play, has been refused by the licensing body or copyright holder. In the matter of The Johannesburg Operatic and Dramatic Society vs. Music Theatre International and Others, the provisions of Section 28 as well as other provisions of the Act were fully considered.
