oa De Rebus - Delegation of motorist's duty

Abstract

In a recent case a road construction firm had contracted with a fleet-owner to cart gravel from a roadside quarry to points along the main road, which was being re-surfaced. Due to the presence of wattle scrub on either side of the access road leading from the quarry to the main road, and a blind rise in the main road itself, the lorry drivers had little or no opportunity of observing whether or not the main road was clear of traffic.
