A case of doctrinal entanglement and a step closer to the legitimate democratisation of religion. The Divorce Amendment Act slipped relatively inconspicuously into our statute books on 22 November 1996. The thrust of the amendment essentially contained in its preamble seeks to 'empower a court to refuse to grant a decree of divorce if it appears to the court that the spouses are bound by their religion to effect a divorce in accordance with their religion before a decree of divorce will have full effect; and to provide for matters connected therewith'.
