We live in an age where every aspect of life is being invaded by developments in information and communication technology. The buzzword of the nineties is the so-called 'information highway' whereby information and communication networks give access to almost any kind of information at any time virtually anywhere in the world. These developments are becoming increasingly important in business communications nationally and internationally.
On 10 November 1978 Proc R286/1978 was published in the Government Gazette. In terms of that proclamation s 2 of the Magistrates' Courts Amendment Act 63 of 1976 came into operation on 1 January 1979. The effect of the amendment was the replacement of s 65 of the Magistrates' Courts Act 32 of 1944 by a series of new sections numbered 65 and 65A to 65M. The amending Act was the culmination of many years of effort by the legal profession to bring about an improvement in the system of debt collection which had proved to be completely ineffectual.
