oa De Rebus - The obligation to advise on forms of dispute resolution

 

Abstract

It can now be confidently argued that a legal responsibility rests on every lawyer who advises a client on a dispute, to be equipped to advise on the alternative forms of resolving the dispute.' This proposition, stated and justified in the Adrasa Newsletter of July 1993, does not appear to have been challenged. On the contrary, the case which was made is supported by the many statements by the Minister of Justice in support of alternative dispute resolution (ADR), recognition of ADR in legislation such a the Pension Funds Act 24 of 1956 and by the investigations of the SA Law Commission.
