In his paraphrase of Inst. 2,16 pr. Theophilus explains and the phenomenon of the who is heir in name only. He describes the latter as τό άσώματον δνομα τής κληρονομίας, an expression that seems to be unique to him and does not draw on comparable Latin terminology.
