Extracted from text ... GOVERNMENT AND LEGISLATION A ccording to Section 217 of the Constitution, procurement must be fair, transparent, competitive and cost effective. This Section 217 (1) is executed by the Public Finance Management Act, which controls procurement for central governments, provincial governments and public entities. The Municipal Finance Management Act controls procurement for municipalities and municipal entities. According to Section 217 (2) and (3) of the Constitution, the procurement process also has to be equitable.
