Abstract

An insured bears the onus of bringing the claim under a contract of insurance within the proverbial four corners of the policy. However, an insurer may bear a reverse burden of proof if it alleges that one of the excepted clauses in the policy applies. In that event, the insurer bears a burden of leading evidence to establish a factual foundation proving that the claim falls under the exception.
