In a recent High Court application before Hiemstra AJ, in the North Gauteng High Court, Pretoria, the judge ordered that certain notices of sales in execution (arising from the attachment by the Sheriff of the South Gauteng High Court on behalf of a major South African bank) did not comply with the provisions of Rule 46(7)(b) of the Uniform Rules of Court. Judge Hiemstra went on to declare that the sales of certain immovable property on auction, pursuant to the notices of sales in execution, were null and void.
