n Without Prejudice - The maintenance of surviving spouses : financial law




Surviving spouses entitled to maintenance can receive maintenance due to them from the deceased's estate in a lump sum, rather than in periodic maintenance payments, as was previously the case. But the estate may be diminished by the proceeds of long-term policies going directly to beneficiaries, rather than being considered to be part of the estate. This was the finding of the Appeal Court in the recent case of (2010) ZASCA 95.
