I was recently invited by the South African Society for Obstetricians and Gynaecologists (SASOG) to give a lecture at their mini symposium on the implications of the Consumer Protection Act (68 of 2008 (CPA)) on the healthcare practitioner. Being very familiar with the drastic implications the no-fault regime of the CPA has on every service provider and product supplier, I still left the symposium being shocked by the fear instilled in the medical profession by the CPA and medical negligence litigation in general.
