Abstract

S26(a) of the Attorneys Act, which entitles a member of the public to be reimbursed by the Fidelity Fund if an attorney steals trust money, excludes transactions where an attorney is merely acting as the representative of a creditor and recourse to the Fidelity Fund may only be sought in narrowly circumscribed circumstances relating to money entrusted to the attorney.
