Abstract

There is no South African case law nor are there any published articles on what possible steps a trade mark or copyright proprietor can take to prevent the unauthorised use, by third parties, of its trademarks or copyrighted works on social networking websites (SNWs), specifically Facebook and Twitter. However, the advice given and conclusions reached in international cases and academic writing are fairly consistent.
