Abstract

Oliver Wendell Holmes Jr once said that the life of the common law has not been logic: it has been experience. This was reiterated in the recent case of (294/10) [2001] ZASCA 58 (31 March 2011), where the Supreme Court of Appeal was asked to develop further the law of delict in relation to the recovery of damages for pure economic loss.
