An arbitrator has the power to make a settlement order as an enforceable arbitral award at the request of the parties. Agreement by the parties during the arbitration also gives the arbitrator his or her powers. The appellant and respondents in [2011] ZASCA 82 did business together and, in the course of that business, disputes arose between them which were referred to arbitration.
