The Constitutional Court recently handed down a judgement with major implications for the mining sector. Mankayi v AngloGold Ashanti Ltd ZACC 3 concerned a claim for damages of R2.6 million by Mankayi, who had contracted a disease as a result of alleged exposure to an unsafe working environment on a mine owned by AngloGold.
