The decision of the Supreme Court of Appeal in 2010 (1) SA 356 restated the importance of compliance with the Constitution and applicable statute law when an organ of state concludes a contract with parties other than other organs of state. In addition to compliance with the Constitution and statutory law, the common law must also be complied with.
