On January 31 2012 Indiana became the 23rd State in the US to adopt "right to work" legislation. This legislation prohibits agreements between trade unions and employers requiring membership of the trade union or payment of union dues or fees a condition of employment. Where there is no right to work legislation, employers and trade unions may agree not to hire anyone who is not a trade union member (similar to our closed shop agreements under s26 of the Labour Relations Act (66 of 1995) (the LRA).
