Abstract


Foss-Harbottle J : This case raises an interesting issue regarding the right of a deceased person to sue for impairment of dignity. Mr Mascarpone, who was reputedly a member of one or other mafia (I dare not say which one), met his end while playing five-card draw poker. At a point of high tension in the game he uttered the word "draw" seeking to replace some of his cards. A fellow member of his organisation (and apparently a poor loser) saw it as a challenge, drew his gun and shot Mr Mascarpone in the face.
