AJ van der Walt explains in 3 ed (2011) 3 that during the negotiations preceding the promulgation of the interim Constitution of the Republic of South Africa Act (200 of 1993) (the interim Constitution) and later the final Constitution of the Republic of South Africa, (1996) (the Constitution), some legal scholars raised objections to the inclusion of a property clause in the Bill of Rights, while others queried the nature and structure of such a clause.
