In Van Zyl NO & others v Commission for Conciliation Mediation & Arbitration & others (2012) 33 ILJ 2471 (LC), the applicants (three provisional liquidators) of the company, Charles Potgieter Investments (Pty) Ltd, applied to the Labour Court for the reviewing and setting aside of an arbitration award in which the arbitrator found the respondent's (Van der Westhuizen) dismissal to be both procedurally and substantively unfair.
