On January 18 2013 the North Gauteng High Court handed down judgement in the case of Foschini Retail Group (Pty) Ltd v Coetzee. The case, an appeal from a decision of the Registrar of Trade Marks, dealt with a seemingly simple issue: could Foschini - the owner of the Due South retail chain, and trade mark registrations for the name Due South in 14 different classes of goods and services - stop a man called Coetzee registering the mark Due South & Logo in four other classes?
