Abstract

A class action is a mechanism whereby a single claimant may pursue an action on behalf of a class of persons with a common interest in the subject matter of the action. Every member of the class is then bound by the outcome of the action. While the South African Constitution expressly recognises class actions, it does so in the broadest of terms and there is little legislative or judicial guidance for practitioners on how best to approach these matters procedurally.
