Illegal mining activities deprive the South African mining industry of billions of rand annually. Whereas previously illegal miners were charged with trespassing on mine property, illegal mining now falls within the classification of organised crime. There have, however, been no reported cases of the prosecution of illegal mining activities since the enactment of the Mineral and Petroleum Resources Development Act (28 of 2002) (the MPRDA).
