Excessive pricing is one of the more difficult contraventions under the Competition Act (89 of 1998, as amended) to establish. This was once again evident in the Competition Tribunal decision The Competition Commission of South Africa and Sasol Chemical Industries Limited 48/CR/Aug 10 (5 June 2014) where the Tribunal found that Sasol Chemical Industries had contravened s8(a) by charging an excessive price in relation to purified propylene and polypropylene from 2004 to 2007.
