Abstract

The Constitution has been hailed as one of the world's most enlightened constitutions with an incomparable Bill of Rights. The inclusion of "sexual orientation" as one of the grounds upon which discrimination is prohibited is recognised as far-reaching, progressive and laudable. This is in stark contrast to the situation prevailing in other parts of Africa, where a wave of homophobia has recently washed over the continent.
