In the recent decision of [2014] ZALCD 1 the Labour Court, per Gush, J, sent out a strong warning to employers that, when contemplating the dismissal of an employee for operational requirements, they should comply fully with the provisions of s189 of the Labour Relations Act, 1995, or face the possibility of the maximum punishment from the courts.
