The recent Western Cape High Court decision in the case of is a curious one. Full of US and Canadian references rather than the usual comfortingly familiar UK and EU ones - and with some pretty muddled thinking at times - trade mark purists will hate it. But it does seem to get there in the end. And it contains some valuable lessons for financial services companies, in fact for companies of all stripes. Lessons that I suspect will be completely ignored.
