The Supreme Court of Appeal, on November 25 2014, handed down judgement in the case of Cecilia Goliath v Member of the Executive Council for Health Eastern Cape (MEC) (085/2014) ZASCA 182 in a decision that has revisited the famous case of Van Wyk v Lewis 1924 AD 438 and the application of the maxim of res ipsa loquitur. Both cases involved a claim for medical negligence wherein a surgical swab was retained during a surgical procedure.
