Abstract

The current South African law provides that a manufacturer or supplier of a product may be held liable for loss or damage sustained by a consumer as a result of the use of its defective product, either on a contractual privy (parties to a contract) or on the basis of delict. Product liability may arise when the product manufactured or supplied is defective (for what ever reason), which causes loss or damage to either person or property.
