n Without Prejudice - Copycat on the mat : not the law reports

Abstract

In the course of an informal mediation, the accused, Mr Silk, sought to hand up to the presiding mediator a photocopy of a judgement from the Law Reports. His opponent Mr Stickler (no doubt because the inexorable logic of the judgement - one of mine - destroyed his own submissions) objected that the reproduction and handing up of a copy was an infringement of the Copyright Act and that it was unlawful to do so. The mediator said he was there to mediate and not make a decision (which serves the parties right for circumventing courts) and referred the matter for prosecution. The prosecuting authorities have decided to make this a test case.
