Is 'good cause' a ground upon which application for rescission of a default CCMA arbitration award can be made? In the recent judgement of the Labour Appeal Court, , the court confirmed it is. The constitution and the primary objects of the Labour Relations Act 1995 (LRA) affirm that the listed grounds for rescission in s144 of the LRA, do not exclude 'good cause'.
