In Chauke & Others v Lee Service Centre CC t/a Leeson Motors (1998) 19 ILJ 1441 (LAC) (Leeson Motors), the Labour Appeal Court (the LAC) introduced into the labour law the concept of "derivative misconduct." This concept involves the dismissal of a group of employees who fail to assist the employer in the identification of the perpetrators of misconduct.
