As the year ends, it is an appropriate time to look back at the ASA Final Appeal decisions of 2008, not so much to consider the facts and merits, but to look at the legal "learnings" (as the Americans say) that result. The Final Appeal Committee (FAC) of the Advertising Standards Authority (ASA) is, as the name implies, the final level of decision making within the ASA. A matter brought before this committee will have been considered by at least one, but more often two, lower committees. Once a matter has been decided by the FAC, there is no further level of appeal.
