The National Environmental Management Act (107 of 1998) (NEMA) is based on a number of fundamental principles which require that all organs of state must consider environmental concerns "alongside all other appropriate and relevant considerations, including the State's responsibility to respect, protect, promote and fulfil the social and economic rights in Chapter 2 of the Constitution." Organs of state are mandated with the responsibility of enforcing the plethora of environmental legislation that has been promulgated.
