The plaintiff, Mr Lucre, sued his insurers for an indemnity under a house-owner's policy arising from an alleged burglary at his home. Rejection Insurance Company Limited, as defendant, rejected the claim on the basis that no burglary had taken place. As the plaintiff failed in his submission that there was a presumption that, as a South African house owner, he had suffered a burglary, he was obliged to give evidence.
