Abstract

It is a fundamental principle of SA law that creatures of statute, those various entities created by the state to administer various aspects of public life, are bound by the legislation which created and regulates them. Bearing in mind, however, that the legislator cannot foresee and make provision for every future eventuality, to what extent may a creature of statute carry out its function and engage with the public in the absence of an express provision allowing it to do so?
