The meaning of the phrase "unforeseen and sudden" in the context of machinery breakdown has finally been determined. "Sudden" is not equivalent to "unforeseen" but is sudden in time. In the matter of , the Appeal Court considered whether certain loss of profits, suffered as a result of a loss of production, was covered under a policy of insurance.
