In 2006 (6) SA 235 (CC), 2007 (1) BCLR 1 (also discussed in the chapters on Constitutional Law and Bill of Rights Jurisprudence) the applicant was the Executive Mayor of the Southern District Municipality and the respondent was the Municipality's Chief Executive Officer. The applicant had failed to settle a debt in respect of cell phone use and the Provincial Auditor-General called upon him to account for this situation. In the course of his explanation the applicant made defamatory comments about the respondent, who instituted action.
