Liability for damage caused by defective products is restricted to the fault-based Aquilian action until the commencement of the Consumer Protection Act 68 of 2008 on 24 October 2010. The Act introduces radical and comprehensive law reform: among others, the manufacturer, importer, distributor, or retailer of goods is liable for damage caused by unsafe or defective goods, irrespective of the presence or absence of negligence (s 61(1)) .
