n South African Law Journal - Are cartels skating on thin ice? An insight into the South African Corporate Leniency Policy




Cartels conduct their business in secret and over the years they have become more sophisticated in attempts to avoid detection by competition authorities. One of the ways in dealing with this problem is to impose a corporate leniency policy to entice cartel members to report the cartel to the competition authority to avoid possible penalties if caught. The aim of this article is to analyse the South African corporate leniency policy, to compare the experiences of other countries, and to provide recommendations that would enhance its value and usage.
