Abstract

Section 211 of the South African constitution (Constitution of the Republic of South Africa of 1996) recognises traditional authorities and indigenous law. It provides that traditional authorities which observe indigenous law may continue to function. South African courts must apply indigenous law, but subject to the constitution and any legislation that specifically deals with indigenous law.
