Legal practitioners, as draftsmen of wills, often fail to comprehend the intricacies of will-drafting and do not approach this duty with the necessary providence and exactness. The recognised duties of a legal practitioner in the drafting of wills are principally owed to the testator, but these duties also extend to the testator's beneficiaries. Improper performance of the will-drafting duties lends itself to potential prejudice; and those most likely to be prejudiced are the beneficiaries under the will.
